Defend a Winding Up Petition........
- If you receive a Statutory Demand Rule 7.3 SD1 under s123, we respond to the Creditor by setting out the defence to the debt and saying that if the Statutory Demand is not withdrawn then you will appoint a solicitor and apply for an Injunction within the time limit on the demand to prevent service of a Winding up Petition and dismissal of the Statutory Demand and apply for costs
- If you receive a 7 day Formal Notice letter under s122 (unable to pay your debts when fallen due), we respond by setting out the defence to the debt and saying that if a Petition is issued you will appoint a solicitor and apply for an Injunction within 7 days to prevent advertisement in the London Gazette and seek dismissal of the Petition and apply for costs
- If the company has received a demand or a 7 day letter and done nothing and a Petition has been issued but not advertised in the London Gazette, then we shall send a letter as per 2 above and seek an Injunction to prevent advertisement and dismissal
- If the petition has been advertised in the London Gazette we can apply for a validation order to keep the business afloat (as your bank can freeze all company accounts)and file a statement setting out why the court should not make a Winding up Order and seek directions.
